RESCUE PROGRAM
This ADOPTION CONTRACT is made and entered into this __________ day of ________________ , 200_____, between the AMERICAN MALTESE ASSOCIATION, INC., RESCUE PROGRAM (hereafter referred to as MALTESE RESCUE) and ______________________________________________ (hereafter referred to as the Adopter, whether one or more persons.)
Now, therefore, it is agreed as follows:
1. MALTESE RESCUE agrees to place for adoption the following described Maltese Dog with the Adopter:

2. Adopter agrees to pay a fee of at least $_________ (usual adoption fee is $250.00 but may be more dependent upon the dog) to MALTESE RESCUE. This fee will be applied to spay/neuter expenses, other necessary veterinary care, and essential grooming performed prior to the adoption of the dog, while the dog remained in the care of MALTESE RESCUE.
3. Adopter agrees that the dog will be kept as a home companion and will share the Adopter’s home, being given the same consideration, as would a human family member.
4. Adopter will not use the dog, nor will he/she permit the dog to be used for any illegal purpose(s).
5. Adopter agrees to care for the dog in a humane manner, including, but not limited to, providing adequate food and water, shelter, exercise, and veterinary care, including annual inoculations and heartworm preventative (if recommended by the veterinarian, based on proven local needs) for the duration of the said dog’s life; all in a manner satisfactory to MALTESE RESCUE.
6. Adopter agrees, where possible, to provide a suitable fenced enclosure of an appropriate height to contain the dog and appropriate square footage (minimum 40 sq. ft.) to provide adequate exercise for the size and activity level of the dog. Under NO circumstances is the dog to be routinely tethered as a means of confinement or restraint.
7. Adopter agrees that the dog must be protected by being on a leash when outside a fenced enclosure and will be transported within a vehicle in a safe manner.
8. Adopter agrees that the dog will not be left in a closed vehicle when the outside temperature exceeds 70 degrees or is below 40 degrees Fahrenheit.
9. Adopter agrees that the dog will be confined in the house or garage when there is no one home, except for prolonged absences, such as vacations, when secure and proper care will have been prearranged for the dog (such as boarding at an approved kennel facility or in the care of a responsible dog sitter).
10. It is specifically understood that this dog is placed as a pet, with no warranty as to the quality of the dog. It is NOT to be exhibited in any commercial venture or demonstration.
11. It is specifically understood that on the date of this ADOPTION CONTRACT the dog has been assessed to be in healthy condition, and no warranty exists regarding any future health condition that this dog may develop or exhibit.
12. Adopter agrees to notify MALTESE RESCUE immediately if the dog is lost or stolen, or at the time of its death.
13. Adopter agrees to notify MALTESE RESCUE at the following listed name, address, and telephone number (in paragraph #14) of any change of address or telephone number within 2 weeks of such change.
14. If, for any reason, Adopter is unable to keep this dog for its entire life, Adopter must contact MALTESE RESCUE, (Co-Chairman), ____________________________ at address: _____________________________________________ telephone number (________) _______________________________ to make arrangements to either return the dog or
find a substitute adoption home satisfactory to MALTESE RESCUE. Adopter agrees to ship the dog by commercial airline or to make other arrangements, acceptable to MALTESE RESCUE, to return the dog. Adopter agrees to pay all return costs if a suitable local home cannot be found. Adopter further agrees NOT to sell, give away, or dispose of the dog in any other manner (except euthanasia for medical reasons at the advice of a licensed veterinarian) without prior consent in writing from MALTESE RESCUE.
15. Should Adopter breach any of the agreements contained in this ADOPTION CONTRACT, MALTESE RESCUE shall have the right to rescind the CONTRACT and demand the immediate return of the dog. Should Adopter fail to return the dog, MALTESE RESCUE may seek an Order from a Court of competent jurisdiction for the return of said dog and may retain, as liquidated damages, the sums paid for said dog pursuant to this ADOPTION CONTRACT.
16. Adopter assumes all responsibility for this dog’s actions after the effective date of this ADOPTION CONTRACT as set forth on page 1. Adopter agrees to hold MALTESE RESCUE harmless for any actions of this dog after it is placed with Adopter.
